Terms of Service

1. Acceptance of Terms

Welcome to GamePulz! By accessing or using our mobile application, website, and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and GamePulz. We may update these Terms from time to time, and your continued use of the Platform constitutes acceptance of any changes.

2. Eligibility

To use GamePulz, you must:

  • Be at least 13 years of age (or the minimum age in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable laws
  • Create only one account and provide accurate, current information

If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We are not liable for any losses caused by unauthorized use of your account.

4. Acceptable Use

When using GamePulz, you agree NOT to:

  • Post harmful, threatening, abusive, harassing, or defamatory content
  • Impersonate any person or entity or misrepresent your affiliation
  • Post spam, advertisements, or solicitations without authorization
  • Upload viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated means (bots, scrapers) to access the Platform
  • Manipulate engagement metrics or rewards through fraudulent activity
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Engage in any activity that disrupts or interferes with the Platform

5. User Content

5.1 Your Content

You retain ownership of content you post on GamePulz ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly display, reproduce, and distribute your content on and through the Platform.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent that you have all necessary rights to post your content and that it does not violate these Terms or any third-party rights.

5.3 Content Moderation

We reserve the right to remove or modify any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Rewards and Engagement System

6.1 Earning Rewards

GamePulz features an engagement-based rewards system. Rewards are earned through legitimate participation and engagement on the Platform.

6.2 Reward Terms

  • Rewards have no cash value unless specifically stated
  • Rewards are non-transferable unless expressly permitted
  • We reserve the right to modify the rewards program at any time
  • Fraudulent activity may result in forfeiture of rewards and account termination

7. Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are owned by GamePulz and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Platform without express written permission.

8. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause or notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, the Platform, or third parties
  • Exposes us to legal liability

You may delete your account at any time through the app settings or by contacting us.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEPULZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid us in the past twelve months, if any.

11. Indemnification

You agree to indemnify and hold harmless GamePulz and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GamePulz is incorporated, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiations. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the new Terms.
